By accessing or using the PlexaHost website (the “Site”) and services (the “Services”), you agree to these Terms of Service and all applicable laws and regulations. If you do not agree, you must not use the Site or Services. All materials on the Site are protected by applicable copyright and trademark laws.
Definitions
For the purposes of these Terms:
- “Site” means the PlexaHost website.
- “Services” means hosting products and related solutions provided by PlexaHost, including game servers, dedicated servers, virtual servers, and associated features.
- “User” (or “you”) means any individual or organization that accesses or uses the Site or Services.
Limited License to Use Materials
PlexaHost grants you a limited, revocable, non-exclusive license to temporarily download one copy of the materials on the Site for personal, non-commercial, transitory viewing only. This is a license, not a transfer of ownership. Under this license you must not:
- Modify, copy, or redistribute the materials;
- Use the materials for any commercial purpose or public display;
- Decompile or reverse engineer any software on the Site;
- Remove copyright or proprietary notices;
- Transfer the materials to another person or “mirror” them on any other server.
This license ends automatically if you breach any restriction and may be terminated by PlexaHost at any time. Upon termination, you must delete any downloaded materials in your possession, whether electronic or printed.
“As Is” Disclaimer
All materials and information on the Site are provided “as is.” PlexaHost makes no warranties, express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, non-infringement, or warranties regarding accuracy, reliability, or expected results from using the materials or Services.
Limitation of Liability
To the fullest extent permitted by law, neither PlexaHost nor its suppliers shall be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, profits, revenue, or business interruption) arising from your use of or inability to use the Services, even if PlexaHost has been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations; in those cases, the foregoing limits apply only to the maximum extent permitted.
Accuracy and Updates
The Site may include technical, typographical, or photographic errors. PlexaHost does not guarantee that any materials are accurate, complete, or current. Content may be changed at any time without notice, and PlexaHost has no obligation to update materials.
Payments, Renewals & Refunds
- All Services (including game servers, virtual servers, and dedicated servers) must be paid in advance. Failure to pay may lead to suspension and, ultimately, deletion of your service.
- If you cancel a subscription, ensure you also cancel any recurring payment with your payment provider (e.g., PayPal) if it does not automatically stop. Overpayments caused by failed cancellation scripts may be refunded by PlexaHost.
- Opening a payment dispute may require temporary suspension of your service while the matter is investigated.
- PlexaHost does not store your personal card details directly.
- By renewing (monthly, bi-monthly, quarterly, annually), you agree to continue your subscription for the chosen billing cycle. All renewals are non-refundable.
- For new orders (excluding dedicated servers), a 48-hour cooling-off period applies during which you may request a full refund. After 48 hours, refunds may be declined.
- Dedicated servers are provided on a business-to-business basis and are non-refundable due to their nature and allocation model.
- Invoices are issued 2 days before the due date to help avoid late payment. If the invoice remains unpaid 2 days after the due date, the service may be suspended and a late fee up to 10% may be added (applies to active services).
- PlexaHost may decline to renew any service at its discretion.
- Claiming a free trial waives your 48-hour refund right for the subsequent paid term if you choose to continue after the trial.
- Services used for illegal or malicious purposes are ineligible for refunds, even within the 48-hour window.
Fair Use
By using the Services, you agree to comply with PlexaHost’s Fair Use Policy, as published on the Site. The policy sets out usage guidelines and limits designed to protect service quality for all users.
Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
Abuse & Threats
PlexaHost maintains a zero-tolerance stance toward abusive or threatening behavior, including:
- Harassment of staff or users;
- Threats of violence or harm;
- Discrimination based on any protected characteristic;
- False reporting intended to harm reputation or disrupt services.
Remedies may include warnings, temporary suspension, permanent termination of services and access, and, where appropriate, referral to law enforcement and legal action.
Accounts & Security
You are responsible for safeguarding your login credentials and for all activity under your account. Notify PlexaHost immediately of any unauthorized use or security breach. PlexaHost is not liable for losses arising from failure to secure your account.
Availability & Maintenance
PlexaHost aims for high availability (24/7/365) but does not guarantee uninterrupted service. Scheduled maintenance may occur; where feasible, PlexaHost will provide notice. You acknowledge that downtime may occur and agree PlexaHost is not liable for related losses.
Privacy & Data Protection
PlexaHost respects your privacy. Please refer to our Privacy Policy on the Site for details on how we collect, use, store, and protect personal data.
Termination
PlexaHost may suspend or terminate Services, without refund, if you violate these Terms or engage in prohibited activity, or where PlexaHost deems termination necessary. You may cancel your Services via the client/billing area following the stated cancellation steps.
Dispute Resolution
Disputes arising from these Terms will be resolved through binding arbitration in accordance with rules of an arbitration body selected by PlexaHost. If arbitration is unsuitable in a particular matter, disputes shall be handled by the competent courts in the United Kingdom.
Prohibited Conduct
You must not:
- Break any applicable laws or regulations;
- Infringe third-party rights or access/use third-party systems without authorization;
- Interfere with or disrupt the Site or Services;
- Distribute malware, harmful code, or engage in other malicious activity.
Third-Party Links
The Site may link to external websites or services not owned or controlled by PlexaHost. PlexaHost is not responsible for the content, privacy practices, or policies of third parties and will not be liable for any damage or loss arising from your use of such sites. Review the terms and privacy policies of any third-party sites you visit.
Force Majeure
PlexaHost will not be liable for delays or failure to perform due to events beyond its reasonable control, including natural disasters, acts of war, labor disputes, utility outages, or other emergencies.
Support Response Times
We aim to respond to support tickets within 2 hours, circumstances permitting. During peak periods, responses may take up to 72 hours.
Submitting multiple tickets in rapid succession may push your request to the back of the queue. Continued misuse of the ticket system may result in temporary or permanent loss of support access.
Backups
- By default, PlexaHost keeps two snapshot copies for Virtual Dedicated and Virtual Private servers. Shared Game Servers receive a minimum of 5 backups (free tiers excluded). Backups are stored on a separate machine.
- Dedicated Servers do not include backups. You are solely responsible for your backup strategy; PlexaHost is not liable for data loss due to hardware/software issues.
- Backups are secured on a remote server and are not directly accessible by customers.
- We strongly recommend maintaining independent copies of your data. If backups are unavailable due to user error or PlexaHost error, PlexaHost is not responsible for resulting data loss.
